Real Estate lawyer Eby awarded Young Attorney Award by Douglas-Elbert Bar Association

Castle Rock lawyer Donald Eby received the 2013 “Young Attorney Award,” from the Douglas Elbert Bar Association. This award is given to one attorney annually for his or her contribution to the Douglas-Elbert Bar Association.

Mr. Eby leads the real estate practice at Robinson & Henry, P.C., a Castle Rock law firm. Bill Henry, managing partner at Robinson & Henry said, “it is truly an honor to receive such a prestigious award from the bar association. The fact that Mr. Eby was awarded the Young Attorney Award continues to demonstrate his strong work ethic on behalf of his clients and the local legal community.”

Are you a Colorado landlord? Did you know that you are responsible for ensuring that carbon monoxide alarms are installed in your rental and are functioning before each new tenant moves in?

Among your requirements under Colorado Revised Statute § 38-45-104, you must

• Ensure that any batteries necessary to make the carbon monoxide alarm operational are provided to the tenant when he or she moves in
• Replace any carbon monoxide alarm if notified by a tenant that it was stolen, removed, found missing, or is not working
• Fix any broken carbon monoxide alarm before a tenant moves in, and if notified by your tenant during their occupancy
• Install a carbon monoxide alarm if one is not present for any tenancy beginning after 2009

“We built a new home on property that was vacant for approximately Five years. During the five year period a neighbor encroached on the property several feet with a fence, garden, parked trailers, cars and shed. Neighborly talks had no effect on them moving any of the items. We were only met with anger, retaliation by putting more items on the property, and shouts of “Public Access rights” and “eminent domain” threats from the neighbor. We engaged Mr. Whitmore as our Attorney, met with him, and followed his recommendations. The encroachments were removed after the neighbor received a letter from Mr. Whitmore explaining in firm words that he, as our Attorney, were willing to pursue any means to recover the rightful property for us. The neighbor is still there, but we have since had a fence placed on the property lines, and things are fairly peaceful for us once more. We would without hesitation enlist the aid of Mr. Whitmore once again should our neighbor begin to disrespect our property owners rights. We cannot thank Mr. Whitmore enough for his opinions, recommendations and legal services. His services, openness with recommendations and friendly involvement made him more like a friend than an advocate. Mr. Whitmore deserve high praise, does not fit the stereotype of the many Lawyers portrayed by a few. He is genuine and involved in the situation we brought before him. Highly Recommended !!”
